Terms of Use

These Terms of Use are an agreement between you and Flying Strategies LLC d/b/a CruiseNCrawl ("CruiseNCrawl", "we", "us"). They apply to the CruiseNCrawl app and the cruisencrawl.com website (together, the "Service"). By using the Service you agree to these Terms. If you do not agree, please do not use it.

Apple license terms

The CruiseNCrawl app is licensed to you, not sold, under Apple's Standard License Agreement (the Apple Media Services Terms and Conditions), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. If these Terms conflict with Apple's Standard License Agreement about your license to use the app, Apple's agreement controls. Apple is not responsible for the app or for providing support for it.

Who can use CruiseNCrawl

You must be at least 18 years old to use the Service. Some features involve bars and alcohol. You must be of legal drinking age where you are to consume alcohol. Drinking is never required to use CruiseNCrawl: mocktails, coffee and other stops count too.

Drink responsibly and cruise safely

CruiseNCrawl is a fun way to explore the venues on a cruise ship. It is not a safety tool. Please drink responsibly, know your limits, never drink and drive, and follow all ship rules and crew instructions. We are not responsible for your choices, your health, or anything that happens during your cruise.

Your account

You are responsible for the information you provide, for keeping your password secure, and for activity under your account. Provide accurate information and do not share your account. You can delete your account at any time in the app (Profile, then Delete My Account). We may suspend or end accounts that break these Terms.

Purchases and subscriptions

• The app may be a paid download. Payment and the download price are handled by Apple through the App Store.
• Master Crawler is an optional auto-renewing subscription, billed monthly or yearly through your Apple ID at the price shown in the App Store when you subscribe.
• Your subscription renews automatically unless you cancel at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours before the period ends.
• You can manage or cancel your subscription any time in your Apple ID subscription settings. Deleting your CruiseNCrawl account does not cancel it.
• Payments and refunds are handled by Apple under its policies. We cannot issue refunds for App Store purchases.
• Features included with the free app and with Master Crawler may change over time.

Your content

You keep ownership of the content you create in the Service, such as crawl names, notes, descriptions, photos and saved Scavenger Hunts. You give us permission to store, display and process that content as needed to run the Service for you and for the people you choose to share it with. Content you mark public, such as a public crawl, can be seen by other users.

Acceptable use

There is no tolerance for objectionable content or abusive behavior. You agree not to post or share content that is unlawful, harassing, threatening, hateful, sexually explicit, violent, deceptive, or that infringes anyone's rights, and not to impersonate others, send spam, scrape or copy the Service, interfere with its operation, or try to access accounts or data that are not yours. We may remove content and suspend or end accounts that break these rules, without notice.

To report content or a user, email appsupport@cruisencrawl.com with the details. We review reports and act on content that breaks these Terms.

Venue information and cruise lines

Ship and venue information in CruiseNCrawl is provided for convenience and may be incomplete, out of date or different from what you find onboard. Venues, hours, names and menus change. CruiseNCrawl is not affiliated with, endorsed by, or sponsored by any cruise line. Cruise line, ship and venue names are trademarks of their owners and are used only to identify them.

Our rights

The Service, including its design, text, graphics, logos and software, belongs to us or our licensors and is protected by law. We give you a personal, limited, non-transferable license to use the Service as allowed by these Terms. You may not copy, modify, reverse engineer or resell it.

Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, to the fullest extent permitted by law. We do not promise it will be uninterrupted, error-free or always available.

Limit of liability

To the fullest extent permitted by law, CruiseNCrawl and its owners and affiliates are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or enjoyment, arising from your use of the Service. Our total liability for any claim is limited to the greater of the amount you paid us through the App Store for the Service in the 12 months before the claim, or 50 US dollars. Some places do not allow these limits, so they may not apply to you.

Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules, and disputes will be handled in the state or federal courts located in Florida, except where your local law requires otherwise.

Changes to these Terms

We may update these Terms from time to time. If we make material changes we will update the date at the top of this page and, where appropriate, tell you in the app. Continuing to use the Service after a change means you accept the updated Terms.
